1. The Defendants: (a) as the victim J Co., Ltd., which created an I hotel complex with the designation of H “H” support facility zone from the Ministry of Land, Transport and Maritime Affairs in the G Mang-si, failed to get investments from domestic investors; (b) the said victim company’s operator K will have an investment attraction from the foreign investment company; and (c) conspired to acquire money as a security for this purpose.

On April 23, 2009, the Defendants made a false statement to the effect that “K would change the 60 million won to be used for attracting investment from L in Thailand.”

However, in fact, even if the Defendants received KRW 60 million from K, they intended to use it for their personal purpose, and there was no intention to use it for the expense of attracting investments from L.

Accordingly, the Defendants conspired to deception K as above and acquired 60 million won from the victim's company outside of the coffee shop, which is the same day.

2. The Defendants offered to K, the operator of the above victim company, a check that is unable to receive money, even if they offered payment to K with the Hong Kong bank, and conspired to acquire money from K under the pretext of receiving money.
