1. The Defendant-Counterclaim Plaintiff (Counterclaim Defendant) shall be marked with a map on the ground of 344m2, Nam-gu, Nam-gu, Seoul at the time of making a port to the Plaintiff (Counterclaim Defendant).
Reasons
1. Basic facts
A. The instant building is unregistered with a single-story building of 217.32 square meters and 131 square meters and 78.3 square meters and 78.3 square meters of reinforced concrete structure with two floors (hereinafter “instant building”) located on the ground of the Nam-gu Seoul Metropolitan Government 344 square meters (hereinafter “instant land”).
B. C. The remainder of the overdue loan was calculated as KRW 30,000,000 and the Defendant agreed to pay the remainder of KRW 35,00,000 until April 30, 2011.
On March 28, 2011, the Defendant paid loan charges of KRW 20,201,390 on behalf of the Defendant, and changed the name of the lending party for the occupation and use of the instant land to the Defendant, and occupied the first floor of the instant building upon delivery.
E. On April 12, 201, the Defendant paid KRW 5,000,000 to the Plaintiff on May 13, 2011, and KRW 15,680,00 on August 11, 2011. On August 30, 2011, the Defendant drafted a certificate of loan that the Plaintiff borrowed KRW 10,00,000 from the Plaintiff by the end of February 30, 2012.
F. The Defendant did not pay the above loan and the remainder after the due date. The Plaintiff visited the F community service center at port at port, and knew that the Defendant’s overdue loan was KRW 20,201,390, not KRW 30,000, not KRW 20,000. Accordingly, on June 27, 2013, the Defendant’s loan charges of KRW 62,201,390, out of the purchase price.
