피고인은 2014. 3. 1. 02:47경 인천 남동구 B 앞에서 피해자 C(30세)에게 호객행위를 하였으나 피해자가 외면한다는 이유로 시비를 걸어 피해자의 멱살을 잡고 흔들며 밀쳐 넘어뜨려 피해자의 얼굴이 땅바닥에 부딪치게 하여 콧등과 코밑이 까지며 빨갛게 멍이 들게 하는 치료일수 미상의 상해를 가하였다.
