1. Defendant B’s land indicated in [Attachment 1. List Nos. 5 and 8] to the Plaintiff Es. Es.S. Specialized in Securitization.
Reasons
1. Facts of recognition;
A. From February 2009 to June 2009, the Industrial Bank of Korea established a collateral security (hereinafter “the instant collateral security”) with respect to each land indicated in the list No. 1 (hereinafter “the instant land”) owned by E and F as the debtor, F and G (hereinafter “F”) and began to build a new building on the instant land.
B. F completed the registration of initial ownership of each building listed in [Attachment 2] List 1 and 2 on May 30, 201, and completed the registration of initial ownership with respect to each of the buildings listed in [Attachment 2] List 1 and 2, and completed the registration of initial ownership with respect to the land trust company on the same day on May 27, 201, and completed the registration of initial ownership with respect to the Defendant A on July 5, 2012.
C. F has completed the registration of ownership preservation on the buildings listed in Attachment 2.3 of Annex 2. List on May 11, 2011, and on the same day, the registration of ownership transfer was completed on the grounds of sale as of May 9, 201 to Defendant B.
G completed the registration of ownership preservation on the building listed in Section 4 of the List No. 2 of May 30, 201, and completed the registration of ownership transfer on May 27, 201 to the Land Trust Co., Ltd. on the same day, and completed the registration of ownership transfer on July 5, 2012 to Defendant A on July 5, 2012.
E. The Industrial Bank of Korea filed an application for voluntary auction on the instant land on February 15, 2012, when F, etc. were in arrears with the repayment of the above loan obligation, and the Plaintiff Es. Es. (hereinafter “Plaintiff Es. Es.”) completed the registration of transfer of ownership on the land listed in paragraphs (1) through (9) out of the land listed in the list on October 14, 2013, due to voluntary auction on September 26, 2013. The Plaintiff Es. C. T. C. (hereinafter “Plaintiff Es. third party”) is a voluntary auction on October 21, 2013 with respect to each land listed in Articles 10 through (14) among the land listed in the list on September 26, 2013.
