All appeals by the defendant and the prosecutor are dismissed.

1. Summary of grounds for appeal;

A. Defendant 1) The Defendant did not assault the victim.

2) The sentence of the lower court (six months of imprisonment) is too unreasonable.

B. The Prosecutor’s sentence of the lower court is too unhued and unreasonable.

2. Determination

A. According to the evidence duly adopted and examined in the lower court’s determination on the Defendant’s assertion of mistake of facts, the victim was assaulted by the president of the instant entertainment center on April 1, 2016, after she was abused by someone on the same day from the instant entertainment station.

The facts stated: (2) On April 6, 2016, the victim identified the defendant, who is the president of the instant entertainment center, as the person who assaulted him/her by the police on the ground that he/she was the victim; (3) on April 9, 2016, the defendant asked L to request that only the victim met the victim at L amusement centers and asked investigation agencies to speak that there is no violence against him/her; and (4) on April 14, 2016, the victim asked the victim to take the drinking place and 20,000 won for traffic expenses; and (5) on the part of the police to request the victim to make a false statement from the victim on several occasions from around May 2016, the victim requested the victim to do so on several occasions and arrange his/her job by having requested the victim to do so at the prosecutor's office that he/she would not know whom he/she was the victim, and (5) on December 16, 2016.

The reason why a false statement was made in the first prosecutor's investigation that he/she would have been abused is because he/she received the request from the defendant for a false statement several times, and the defendant stated that "no one has disturbed the victim" in the first prosecutor's investigation on December 2, 2016. However, the defendant made a statement on December 9, 2016 at the second prosecutor's investigation on December 2, 2016.
