1. The instant lawsuit shall be dismissed.

Basic Facts

Pursuant to Article 76 of the Local Public Enterprises Act, the Defendant: (a) drafted an Ordinance on the Establishment and Operation of the Gwangju Metropolitan City Mine Facility Management Corporation (hereinafter referred to as the “instant Corporation”); (b) submitted it to the Gwangju Metropolitan City Mine Association (hereinafter referred to as the “Mining Gu”); (c) made a resolution on September 12, 2013 by the Mine-gu Council; and (d) promulgated the said Ordinance on October 1, 2013 by Ordinance No. 1109; (c) among them, Article 19 subparagraph 5 of the said Ordinance and Article 3 (4) of the Addenda (hereinafter referred to as the “Rules of this case”) shall be as follows:

Article 19 of the Gwangju Metropolitan City Ordinance on the Establishment and Operation of the Mine-gu Facilities Management Corporation shall carry out the following projects to achieve the purpose of its establishment:

5. As prescribed by the head of the Gu, with respect to subparagraph 5 of Article 19 of the Addenda to the collection and transportation of household wastes, the Corporation shall be entrusted to the Corporation entirely by applying this Ordinance from July 1, 2014.

The plaintiff's agency contract conclusion and extension is a company that obtained permission for waste disposal business under Article 25 (3) of the Wastes Control Act, and the defendant entered into and extended a contract for the collection and transportation of domestic waste in the mine area with the defendant. The agency area is U-do, U-do, non-children, high-tech 1 and 2, Hanam-dong (excludingHanam-2, Hanam-dong), Gedong, and Hadong, and the contract date and the period of the agency contract are as follows.

The Defendant notified the Plaintiff of the expiration of the period from January 1, 2015 to June 30, 2015, from January 1, 2013, 2013 to December 31, 2013, 2013, respectively.
