Defendant

A shall be punished by imprisonment with prison labor for eight months and by imprisonment for ten months.

However, this judgment is delivered against Defendant A.

Punishment of the crime

The Defendants, as a matter of Chinese nationality, conspired with those who are the daily allowances of the telephone financial fraud organization (one name D; hereinafter referred to as "D"), were in charge of obtaining passbooks and cards to be used for committing a crime by deceiving victims, or letting the victims acquire them deposit cash in the account of another person taken over by the Defendants. Defendant B was in charge of acquiring passbooks and cards to be used for committing a crime of fraud or remitting cash deposited in the said account to the account of a bank (bank on official duty, agricultural bank) located in China (hereinafter referred to as "banks and agricultural bank"), and Defendant A was willing to commit so-called "phishing" crimes, such as taking charge of taking over passbooks and cards through the above D and Defendant B from November 6, 2014.
