The appeal is dismissed.

The court below affirmed the judgment of the court of first instance which accepted part of the claim of this case against the defendant, who is the heir of the deceased, on the ground that the defendant forged the report of marriage under the name of the deceased F (hereinafter “the deceased”), committed a tort of reporting the marriage as if the deceased and the defendant were married genuinely, and further, withdrawn 6 million won by using the deceased’s cash card and stolen it.

In light of the relevant legal principles and records, the above judgment of the court below is just and acceptable, and there is no violation of law by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules.

Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
