A defendant shall be punished by imprisonment with prison labor for not more than ten months.

Punishment of the crime

On June 26, 2013, the Defendant made a false statement to the victim C, “A loan will be made within 10 million won and KRW 5,250,000 won will be made within 70,000,000,000,000,000 won as a guarantee insurance premium.”

However, in fact, the Defendant did not engage in credit business and was planning to use the money remitted from the victim to pay his/her personal debt, so even if he/she received money from the victim as a guarantee insurance premium, he/she did not have the intention or ability to lend 700 million won to the victim.

In this year, the defendant was transferred from the victim to the Gwangju Bank account in the name of the defendant as a guarantee insurance premium for the same day, and the same year from that time.

7. By the end of 23.2, a total of 1,150,000 won was remitted by the same method five times in total as indicated in the annexed Table (1).

Accordingly, the defendant was given property owned by the victim by deceiving the victim.

On May 4, 2015, the Defendant stated that “The Victim D is operating a credit service company E, and the relevant documents are prepared and then loans 30 million won as necessary for the payment of guarantee insurance fees,” to the victim D on May 4, 2015.”

However, in fact, the Defendant did not engage in credit business, and there was no certain income at the time, and there was no special property, and there was no intention or ability to lend 30 million won to the victim even if he received money from the victim as a guarantee insurance premium, since he was planned to use the money received from the victim as the living expense of the Defendant.

On May 5, 2015, the Defendant, by deceiving the victim as such, received 860,000 won from the victim as the guarantee insurance premium for the said loan from the cross-fash in the trade name in the high-end credit dong, Gwangju Northern-gu.
