Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. The Defendant violated the Subsidy Management Act, as a de facto representative of the E Agricultural Partnership Corporation in Si C and D, was selected from May 18, 2012 to October 30, 2013, the Defendant implemented a project of KRW 1 billion in total project cost of KRW 50 million ( KRW 30 million in national subsidies, KRW 30 million in local expenses, and KRW 450 million in self-payment) from May 18, 2012 to October 30, 2013.

When a subsidy program operator or an indirect subsidy program operator completes a subsidy program, he/she shall prepare and submit a performance report on the subsidy program stating the results of the subsidy program, and the performance report on the subsidy program shall not be submitted by submitting a false report, such as attaching an invoice clearly stating the expenses incurred in the subsidy program

Nevertheless, the Defendant received an order from a public official in charge of viewing early May 14, 2014 to supplement the said FF business completion money and the settlement of subsidies, and submitted a statement of business account to the public official in charge of viewing early June 9, 2014 with the performance of the said subsidized project and the settlement report and attached documents. On December 27, 2013, the Defendant prepared a false statement of business account via 28 times in total, such as preparing a false statement of funds transfer account, even if the Defendant transferred KRW 78 million from the above agricultural partnership subsidy account to the agricultural bank account of the said agricultural association corporation from December 27, 2013.

As a result, the Defendant made a false report in the process of attaching an invoice clearly stating the expenses incurred in the subsidized project by financial resources to the performance report on the subsidized project.

2. Around December 24, 2014, the Defendant, at the above E farming association office, prepared “the report on the result of the participation in the individual exhibitions specializing in overseas exhibitions” with the content that “from December 4, 2014 to June 6, 2014, the Defendant attended the Chinese Hudern franchise counseling conference from E farming association to China in 2014 and paid KRW 5,40,000 at the ss expense.”
