A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On November 25, 2017, the Defendant posted a false statement to the effect that he would sell a ticket to “C” online at Asan City, Asan-si, and then sent it to the victim D who reported and contacted the above writing to “I will send it to door-to-door.”

However, at the time of fact, the Defendant was merely the intent to receive the payment of crowdfunding by deceiving the victim and to use it for the cost of living, and did not have the intent or ability to send the money to the victim.

As above, the Defendant, by deceiving the victim, received KRW 170,00 from the victim to the EUnion account in the name of the Defendant on that day, and by deceiving the victims in the same way as in the separate crime list from March 12, 2019, and then transferred KRW 2,120,000 from the victims.

Accordingly, the defendant deceivings victims to acquire financial benefits.

2. On March 6, 2019, the Defendant posted a notice to the effect that he would sell Blus earphones to the Internet “G” from Asan City, and then sent a false statement to the victim H who reported and contacted the above writing to the effect that “The Defendant would send Blus earphones to the bank account in I’s name.”

However, at the time, the Defendant, by deceiving the victim, was merely the intent of having the victim pay the food cost ordered by the “J” operator, on behalf of the victim, and did not have the intent or ability to send the earphones to the victim.

The Defendant, by deceiving the victim as above, had the victim transfer KRW 26,00 to the EUnion account in the name of I, and received food equivalent to the same amount from I.

In this respect, the Defendant acquired pecuniary benefits by deceiving the victim.
