A defendant shall be punished by imprisonment for one year.

Punishment of the crime

From November 1, 2013, the Defendant is a person who carries on the business of producing fertilizers, etc. in the name of the Si/Gu-si B (hereinafter referred to as the “C”) from around November 1, 2013, and D is a person who supports a business that is publicly announced by the Ministry of Environment based on environmental technology and environmental industry support, etc., with a loan of environmental industry promotion funds.

On July 3, 2017, the Defendant filed an application for a loan with the victim to raise funds necessary for the construction of a factory building and machinery and equipment at the above C office. However, upon receiving the notification from D’s employees E that “the permit for waste disposal is required for a loan,” the Defendant submitted the waste disposal business plan at the time of through management, but it cannot obtain the approval for the said document by receiving the determination that it is inappropriate for the waste disposal facility standards from the through management. As such, the Defendant failed to obtain the approval for the said document under the name of the Tong market by forging the “reasonable notice on the application for the permission for waste disposal business” and submitted it to the victim by forging the “the due notification on the application for the permission for waste disposal business.”

1. On August 25, 2017, the Defendant forged official document: (a) taken and printed out the official document on the extension of permission to engage in a waste treatment business under the name of the Tong Young Market, which was already prepared, into a mobile phone; (b) taken the upper end of the said official document (the part printed by Tong Young-si and relevant CI) and the lower end (the part printed by the official seal, official draft, approval person, etc.) into a knife; (c) put it on a prepared paper A4 form; and (d) put it out to a prior notice of the propriety of waste treatment to C using a computer; and (d) forged “the timely notice of application for permission to engage in a waste treatment business” in the name of the Tong Young Market by attaching it to the above A4 form.

2. The Defendant’s uttering of forged official documents shall be the date and time stated in paragraph 1.
