The prosecution of this case is dismissed.

1. On March 10, 2019, at around 00:06, the Defendant, who was waiting for treatment in the emergency room of the hospital in Dongjak-gu Seoul Metropolitan Government, took a bath to “the victim D(34 years of age) who is security personnel of the above hospital,” and assault the victim at one time on the part of the victim’s chest, 2-3 sealed the victim’s sexual donation, and assaulted the victim at one time, on the ground that the victim D(34 years of age), who was a security personnel of the above hospital, intending to promptly undergo treatment.

2. Determination

(a) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act;

B. On November 11, 2020, the victim expressed his intention that he does not want the punishment of the defendant after the indictment of this case.

(c) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
