A defendant shall be punished by imprisonment for two years.

The defendant shall be ordered to complete a sexual assault treatment program for 80 hours.

Punishment of the crime

On February 23, 2011, the Defendant was sentenced to a suspended sentence of six months for committing a violation of the Act on the Protection of Children and Juveniles against Sexual Abuse (i.e., sexual purchase). On November 28, 2012, the Defendant was sentenced to a suspended sentence of eight months for a violation of the Punishment of Violences, etc. Act (a violation of the Act on the Punishment of Violences, Etc.) at a high support court of the District Court, and completed the sentence on July 29, 2013.

1. Around October 8, 2013, the Defendant became aware of juvenile C (nive and 13 years of age) through smartphone-free hosting and drug holding around October 8, 2013. Around the 9th day of the same month, the Defendant paid 30,000 won to C in return for sexual traffic at the Defendant’s residence located in the Da branch of Sungnam-si, Sungnam-si, and paid 30,000 won to C in return for sexual traffic and had sexual intercourse with C. From that date to November 10, 2013, the Defendant had expressed 20 times as indicated in the list of crimes.

2. On July 30, 2013, from around 00:21 to July 04:11, 2013, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (obscenity using a telecommunication medium). From around 00:21 to around 04:11, 2013, the Defendant putting the Defendant’s cell phone at the Defendant’s residence located in Seongbuk-gu, Sungnam-si, E with the victim F (15 years of age) using the Defendant’s mobile phone. “I ambling on the nicker, liverer, and continuous knicker without any nicker, slick, slick, slick, and slicked, hicked, humped, humped, humped, humped, hump, hump, hump, hump, hump or hump.”

Accordingly, the defendant is able to feel sexual humiliation or aversion through mobile phones with a view to inducing or satisfying his own sexual desire.
