Punishment of the crime

그럼에도 피고인은 2014. 10. 24.경부터 2014. 11. 1.경까지 목포시 C에 있는 ‘D’을 운영하면서 위 오락실에 청룡기 게임기 40대를 설치하여, 불특정 손님들로 하여금 게임기에 돈을 넣으면 100원당 100점이 적립되고 이른바 똑딱이를 통해 자동적으로 게임이 실행되게 한 후, 게임기 화면에 특정 계급장(대위, 소령, 중령, 대령, 준장, 소장, 대장, 원수)이 나오면 각 계급에 따라 1만 원, 2만 원, 5만 원, 10만 원, 20만 원, 30만 원, 50만 원, 60만 원 상당의 점수보관증을 교부하고, 손님들로 하여금 피고인이 고용한 환전상 B에게 점수보관증에 기재된 금액 중 수수료 10%를 공제한 나머지 금액을 현금으로 교부받게 하였다.

Nevertheless, around October 23, 2014, the Defendant decided to work for money exchange in return for receiving KRW 100,000 per day from the business owner A of the said “D”. From October 24, 2014 to November 1, 2014, the Defendant exchanged the remainder of the amount obtained by deducting 10% of the fee from the amount entered in the said “D”’s game while carrying out the game, and from October 24, 2014, the Defendant exchanged the amount after deducting 10% of the fee.

As a result, the defendant exchanged the result obtained through the use of game products.
