2. 특수협박 피고인은 2018. 8. 28. 20:30경 전남 곡성군 D에 있는 E산장 부근 F에 주차된 피해자 소유 G SM3 차량 안에서 피해자가 차량을 운전하여 갔던 곳을 확인하기 위해 차량 블랙박스를 뜯고자 하였으나 뜯지 못하였고, 그 후 피해자의 휴대전화를 보고 피고인과의 문자, 사진 등이 모두 삭제된 것을 확인하자 화가 나 피고인의 자리에 위험한 물건인 회칼을 보관한 상태에서 운전석에 앉아있던 피해자에게 “클랙슨을 누르거나 문을 열거나 하면 바로 칼로 찌르겠다. 진작 죽이려고 했는데 너 생일 지나고 죽이려고 시간을 끌었다. 오늘은 죽여야 한다.”고 말하여 피해자에게 겁을 주었다.
