Defendant shall be punished by a fine of KRW 1,500,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

On February 20, 2013, the Defendant was sentenced to a suspended sentence of imprisonment with prison labor for four months at the Incheon District Court for fraud, and on February 28, 2013, the said judgment became final and conclusive.

Even if the PC is used by the Defendant, the Defendant did not have any intention or ability to pay the price.

Nevertheless, on June 26, 2012, from around 07:28 to 17:30 on the same day, the Defendant used the victim C’s PC on the second and second floor B and the second floor B in Si interest, and did not pay an amount equivalent to 12,200 won, thereby acquiring a considerable pecuniary benefit.

1. On June 27, 2012, from around 19:30 on June 27, 2012 to around 05:00 on June 28, 2012, the Defendant filed an application for computer use as if the Defendant had no intent or ability to pay the fee, and then acquired the pecuniary benefits equivalent to KRW 11,700 of the fee by using the computer provided by the victim.

2. On June 28, 2012, from 08:31 to 17:00 on June 29, 2012, the Defendant filed an application for the use of a computer as if he/she had no intent or ability to pay the usage fee, and acquired the pecuniary benefit equivalent to 33,000 won of the usage fee by being provided with the computer from the victim.

3. On August 17, 2012, from around 13:00 on August 17, 2012 to August 21, 2012, the Defendant filed an application for computer use with the victim K on the second floor of the Nam-gu Incheon Metropolitan City L, and then filed an application for a computer use as if he would pay the normal usage fee despite the absence of the intent or ability to pay the usage fee, and then use the computer with the victim’s financial benefit equivalent to 32,200 won.
