1. The Defendant’s revocation of the decision to grant a subsidy to the Plaintiff on December 29, 2015 and the subsidy granted on April 25, 2016.
Reasons
1. Details of the disposition;
A. A. On February 2009, the Defendant: (a) designated the Plaintiff as a proprietor of a fishery product processing facility business (hereinafter referred to as “the instant subsidized business”); (b) upon the Plaintiff’s application for subsidies, granted KRW 480,00,000 [total project cost of KRW 800,000 (total project cost of KRW 240,000,000, 72,0000,000, Si expenses of KRW 168,000,000, Si expenses of KRW 320,000,000; (c) and the decision to grant subsidies of KRW 320,00,000 [total project cost of KRW 670,945,00,000] on November 16, 2012; and (d) decided to grant subsidies of KRW 80,000,008,000 (total project cost of KRW 670,000,008,3886,0886,0088
B. The Defendant paid the State and local subsidies of KRW 793,208,40 in total to the Plaintiff four times as indicated below [the total amount of KRW 396,60,200 (the Do subsidy of KRW 118,981,260, Si subsidy of KRW 277,62,940)] to the Plaintiff as indicated in the following table.
On March 6, 2009, the total cost of installing facilities (including buildings) 240,00,000,000,000 168,000,000 480,000,000 on March 27, 2012, 45,912,900 13,773,870,32,139,030,030, 91,825, 800 on March 29, 2013; 42,53636,40,647,636,408,636,40,07, including the cost of installing waste pipes on March 29, 2013;
C. The Plaintiff, using the instant subsidy, newly constructed a steel-frame structure sand panel site and a single-story factory (hereinafter collectively referred to as “instant factory”) on the instant land owned by the Plaintiff (hereinafter referred to as “instant site”). On July 7, 2009, the Plaintiff installed a retaining wall around the instant factory, around December 2012, installed the retaining wall and extended the water power plant around the instant factory, around March 2013. On May 2013, 2013, the Plaintiff purchased a cryp building and a working unit installed and installed a water tank.
On March 15, 2012, the Plaintiff is a Sim-si Fisheries Cooperatives (hereinafter referred to as "Gumju-si Cooperatives").
