Reasons
Punishment of the crime
The defendant of "2015 Highest 798" is between C and his/her friendship, and C is the shot of D and E.
The Defendant, along with C and E, pretended that a genuine rental contract was concluded with D in order to obtain a loan from a new capital company of the victim, by securing the claim for the return of the lease deposit with C and E, and had mind that the Defendant was deceiving the victim as if the lessor had the claim for the return of the lease deposit against D.
1. On March 24, 2013, at the house of Gyeyang-gu Incheon, the Defendant, along with C, requested “A” to “a receipt that the lessor has received the deposit as security, if he/she intends to obtain a loan as security for lease deposit, shall submit it to the lending company.” On the other hand, the Defendant: (a) the amount of deposit for lease on the second floor of G G 2,000,000,000,000 in a manner that the Defendant was accompanied by and accepted by C;

3. The balance of KRW 75 million was received regularly, and on March 23, 2013, stated as D, “D,” and affixed the seal of the said D, which C was kept in custody next to that name.
Accordingly, the Defendant, in collusion with C, forged a receipt in the name of D, which is a private document on rights and obligations, for the purpose of uttering.
2. On March 25, 2013, in collusion with C, the Defendant exercised the forged receipt as if it were a document duly formed to H, an agent of the Gyeyang-gu Incheon Gyeyang-gu Seoul Gyeyang-gu Co., Ltd., the agent of the agent of the Hanpo Capital Co., Ltd., which was aware of the forgery.
3. On March 25, 2013, the Defendant: (a) performed as if he/she concluded a lease contract with D at the office of Gyeyang-gu Incheon, Gyeyang-gu, Seoul, the agent of the victim New Capital Co., Ltd.; (b) presented the lease contract and receipt, etc. as stated in paragraph (1) written with C and E; and (c) entered with C on February 20, 2013, A moved into the office of Gyeyang-gu, Incheon, in KRW 80 million; and (d) gold.
