A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On August 11, 2006, the Defendant sentenced ten months to imprisonment for fraud at the Suwon District Court, and completed the execution of the sentence in the Suwon Detention House on February 10, 2007.

In collusion with a loan fraud group, the Defendant was offered to obtain a part of the profit by acquiring a loan from a bank by acquiring real estate from the bank as collateral, and was given the consent by suggesting C, which was known to the general public, to play a role of lending the name of the lender.

1. Fraud;

A. On April 27, 2009, the Defendant, along with C, prepared a real estate sales contract in the name of Bupyeong-gu, Incheon with Down-gu, Incheon, with respect to subparagraph 301 of the Real Estate Act, and a loan document secured by the said real estate. The Defendant, upon submitting the contract to the Suwon-dong branch, who is the victim, induced the employee in charge as if he would normally receive a loan for the remainder of the above loan.

However, in fact, the Defendant purchased real estate in the name of only the seller of the down payment, and paid the balance after receiving a loan from a financial institution as security, and then brought the lease money immediately out of the lease money, and the Defendant intended to acquire the loan by means of making the real estate more than the auction without paying the loan money.

As above, the Defendant, in collusion with the lending fraud group and C, received KRW 70 million from the victimized bank as a loan.

B. On May 6, 2009, the Defendant prepared a real estate sales contract and loan documents with C about subparagraph 101 of the G building underground in Gyeyang-gu Incheon Metropolitan City, along with C, at the F Certified Judicial scrivener Office located in Nam-gu Incheon Metropolitan City, and submitted them to the Songwon, the injured party, and submitted them to the Songwon Credit Union.

In the same manner as this paragraph, the injured bank received 69 million won as a loan.

C. Around May 7, 2009, the Defendant prepared a real estate sales contract and a loan document with H A certified judicial scrivener office located in Bupyeong-gu Incheon, Incheon, with C, and with C, with the real estate sales contract and a loan document with regard to I and 302, and is the victim.
