1. On April 17, 2018, the Central Labor Relations Commission rendered a decision of review as to the case of application for reexamination of unfair dismissal C.
Reasons
1. Details of the decision on retrial;
A. On May 9, 197, the Plaintiff was established for the purpose of higher education, etc. and employs approximately five hundred full-time workers, and establishes and operates D High Schools and E University (hereinafter “instant University”).
The Intervenor joining the Defendant (hereinafter referred to as the “ Intervenor”) was employed by the Plaintiff on March 1, 1996, and worked at the Central Library Information Team from June 24, 2016 to June 29, 2017 at the University Building and Design University Teaching Support Team, from which the Intervenor was employed by the Plaintiff.
B. On September 29, 2017, the Plaintiff notified the Intervenor that the Intervenor was dismissed as of October 1, 2017 based on the grounds of sexual harassment (grounds 1 through 4), assault (grounds 5), verbal abuse (grounds 6 through 8), public funds embezzlement (grounds 9), and disciplinary reasons for negligence of duties (grounds 10) as stated below (hereinafter “instant disciplinary reasons”), Article 61(1) of the Private School Act; Article 3 subparag. 1, 3, 4, and 11 of the Regulations on the Service of Faculty and Staff of the University of this case; and Article 3 subparag. 1, 3, 4, and 11 of the Regulations on the Service of the University of this case.

On May 25, 2017, the first intervenor, who did not take a summary of the grounds for the disciplinary action Nos. 1 and 7, was at the 7th floor of the building design center around May 25, 2017, who had been in the office of the building and design university teaching support team at the 7th floor of the building and design university.
Around April 2017, 2017, the 2 intervenor of the first disciplinary ground 2 stated that “F is so big that it can drink” while drinking F, G, H, I, and I in the office of the school support team of the building and design university.
Around April 2017, 2017, the third intervenor of the second disciplinary ground stated that “in the case of another department, students have good body and first sold their arms, and first failed to have the arms.”
On January 2017, the fourth intervenor on the ground of the disciplinary action does not seem to have "the way to live" while dialogueing F with F in the office of the Building and Design University School Education Support Team.
