Reasons
Punishment of the crime
[Criminal Power] On August 13, 2009, the Defendant was sentenced to two years of imprisonment with prison labor for the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) and the Road Traffic Act (non-licensed driving) at the Gwangju District Court. On March 30, 201, the Defendant was released on March 30, 201 during the execution of the sentence, and the parole period passed on May 24, 201.
【Criminal Facts】
1. Violation of the Aggravated Punishment Act;
A. At around 02:00 on March 3, 2013, the Defendant: (a) opened a ebaba2 car parking lot in the Gwangju Mine-gu C apartment complex 6 underground parking lot; (b) opened a ebaba2 car parked by the victim D; and (c) opened a ebaba2 car with the key installed in the key hole of the said car without the victim’s consent by using the key attached to the said ebaba; and (d) returned to the Gwangju Mine-gu by not later than 05:40 on the same day by driving the said car, and used the said car as a date, and cut it with the said key
B. At around 00:50 on March 10, 2013, the Defendant: (a) opened and entered the door of the Ebata2 car in an amount of KRW 1.5 million at the market price parked by the victim D using the stolen key; and (b) driven the said car by driving it at the speed of the city.
C. At around 02:00 on March 14, 2013, the Defendant opened a door that was parked by the victim G in the F apartment underground parking lot in Seo-gu, Seo-gu, Seo-gu, Gwangju, and opened a door that was not corrected for the H AB car that was parked by the victim G, and cut three and five packaging cans equivalent to the total market price of 5,000 won owned by the victim in the between the said car tracks.
On May 2, 2013, at around 03:00, the Defendant opened a door that was parked by the victim JJ in the I apartment parking lot in Gwangju Mine-gu, Gwangju, with cash of KRW 600,000 and the market value of KRW 15,000,000 in total, the Defendant cut off and stolen the vehicle.
