Reasons

Punishment of the crime

The Defendant is the actual representative director of E Co., Ltd., which was located in Dong-si, Chungcheongnam-si, North America, and has been engaged in the manufacturing of metal parts and automobile parts by using five regular workers.

When a worker retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred.

Provided, That the date may be extended by an agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant did not pay 11,350,000 won in total, including wages of 2,050,000 won on November 1, 2018 of the FF retired on May 1, 2019 at the said workplace, wages of 450,000 won on December 201, 2018, wages of 2,150,000 won on January 1, 2019, wages of 1,70,000,000 won on February 2, 2019, wages of 2,50,000 won on March 3, 2019, and wages of 2,50,000,000 won on April 1, 2019 between the parties, within 14 days from the date of retirement without agreement on the extension of the due date.

The Defendant, “2020 Go-si118,” is the former representative director of E, a corporation located in Gyeong-si, Chungcheongnam-si, Chungcheongnam-si, and is an employer who runs the manufacturing business of metal parts and automobile parts using five full-time workers.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money and valuables within fourteen days after the cause for such payment occurred.

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant did not pay 1,00,000 won for August 1, 2018 of G retired on May 1, 2019; 2,00,000 won for September wage; 1,30,000 won for October wage; 2,000 won for December wage; 2,00,000 won for December wage; 2,000,000 won for February wage; 2, 200,000 won for February wage; 2,000,000 won for March wage; and 2,00,000,000 won for March wage for April wage; and 2,000, total wage for April wage for 14, 200; and 14,500,000 won for payment (tax) within the date of retirement without agreement between the parties concerned.
