1. Each of the plaintiffs' claims is dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. The Defendant is a trustee and executor who entered into a management-type land trust contract with G Co., Ltd. that carries on the new construction and sale of Goyang-si and E Commercial ground-based officetels (hereinafter “instant officetel”).
B. On August 26, 2019, Plaintiff A concluded the instant officetel H on KRW 142,310,000 (the contract amount of KRW 14,231,00 on the date of the contract; the intermediate payment of KRW 14,231,00 on the date of the contract; the contract amount of KRW 5 times from July 30, 2018 to November 30, 2019; and the contract amount of KRW 14,231,00 on the date of the intermediate payment; and the remainder payment of KRW 14,200 on the date of the contract payment; and the contract amount of KRW 30,00 on the same date as the date of the contract payment; and the contract payment of KRW 14,231,00 on the same date as the date of the contract payment; and the contract payment of KRW 40,50,000 on the same date as the date of the contract payment; and the contract payment of KRW 14,2300,400.
Plaintiff
A, on September 5, 2019, entered into a contract with the Defendant to sell the instant officetel Nos. 143,380,000 (the contract amounting to KRW 14,38,00 on the date of the contract, the intermediate payment to KRW 14,38,00 on the five occasions from July 30, 2018 to November 30, 2019, each designated date of KRW 14,38,000 per each time (the remainder, KRW 57,352,00 on the designated date of the tenant) (hereinafter referred to as the “second-sale contract”), and accordingly, paid the Defendant the down payment to KRW 14,338,00 on the same day.
C. On September 7, 2019, Plaintiff B entered into a contract with the Defendant to purchase the instant officetel J (hereinafter “third-sale contract of this case”) at KRW 143,380,000 (the contract amounting to KRW 14,38,00 on the date of the contract, and the intermediate payment to November 30, 2019 each designated date of KRW 14,338,000 per each time from July 30, 2018 to November 30, 2019 (the payment of KRW 57,352,00 on the date of designating the tenant”) and accordingly, paid the Defendant KRW 14,38,00 on the same day to the Defendant.
