1. The plaintiff's appeal is dismissed.
2. The costs of appeal shall be borne by the Plaintiff.
The purport of the claim and appeal is the purport of the appeal.
Reasons
1. The reasoning of the judgment of the court of first instance citing this case is as follows, and this case is cited in accordance with the main sentence of Article 420 of the Civil Procedure Act, since the reasoning of the judgment of the court of first instance citing this case is the same as that of the court of
"The purport of the whole entries and arguments of evidence Nos. 3, 6 through 8, 11, 14, 15, 18, 13, 20, 21, 23, and 27 of the first instance judgment" shall be construed as "the purpose of the whole entries and arguments of evidence Nos. 3, 6 through 8, 9, 11, 14 through 18, 29, 32, 56, 59, 72, Eul evidence No. 13, 20, 21, 23, 27, 31, 32, 41, 42, and 444 of the first instance court witness and all pleadings".
The 8th to 9th one (3) of the first instance judgment (3, 4th) shall be followed by the following:
“A person who establishes and operates an art gallery in Article 6(3) of the Museum and Art Gallery Support Act (Act No. 4541, Mar. 6, 1993) and Article 5 of the Enforcement Decree of the same Act (Presidential Decree No. 13881, Apr. 30, 1993) provide that “The person who establishes and operates an art gallery may register with the competent authorities any art gallery material and facilities necessary to achieve the purpose of its establishment, while the art gallery material required for registration was more than 100 points, the person who meets the standards required in the law first of all as administrative procedures for the establishment of the art gallery and registered only 130 points as a material that can represent the art gallery as a material that can represent the art gallery.”
While only 130 points of the above registered work donated D to Defendant Foundation, in light of the technical content of D’s books, etc. as seen earlier, the purpose of establishment and operation of Defendant Foundation and K Art Gallery, D does not divide C’s paintings into donated goods and non-donations.
