Defendants shall be punished by imprisonment for eight months.
Reasons
Punishment of the crime
1. The Defendants conspired to acquire property benefits by deceiving the victims on three occasions as follows.
At around 13:30 on November 23, 2014, the Defendants related to the victim D had the victim D's "F restaurant" operated by the victim D in Suwon-gu, Suwon-si, Suwon-si, and had the victim enticed the victim as if he did not have the intent or ability to pay the food, etc. even if he did not order the food, etc., and he was provided with the victim with the 35,000 Ssam Schina and 1 disease, etc., but did not pay the amount.
B. At around 01:00 on November 24, 2014, the Defendants related to the Victim G had the victim G in Suwon-gu, Suwon-gu, Suwon-si, by deceiving the victim as if he did not have the intent or ability to pay the food, etc. even if he did not order the food, etc., and by deceiving the victim as if he did not have the intent or ability to pay the food, etc., and even though he was provided by the victim with one well-dying ice laves worth worth KRW 21,000 and two soldiers, etc., he did not pay the amount.
C. At around 11:00 on November 30, 2014, the Defendants related to the Victim J-related Defendants: (a) enticed the victim as if they were unable to pay the price in a normal manner despite having failed to do so despite having ordered food, etc.; (b) by deceiving the victim as if they were not able to pay the price in a normal manner; and (c) even though the Defendants were provided with two director-generals of administrative bureau in the amount of KRW 22,00 and three soldiers of executive bureau in the amount of KRW 22,00, it did not pay the price.
2. The Defendant, at around 18:00 on November 19, 2014, by “O station” operated by the Victim N in Suwon-si M, Suwon-si, Suwon-si, and Defendant B, by deceiving the victim as if he did not have any intent or ability to pay the price even if he orders food, etc., and by deceiving the victim as if he did not normally pay the price. The Defendant was provided by the victim with one two-kimchi, one of which is equivalent to KRW 31,000, one of two-kimchi, and two-kicks.
