Defendants are not guilty.
Reasons
1. Summary of the facts charged
A. Defendant A (1) A was under the influence of alcohol level of 0.179% on September 18, 201, Defendant A driving a G Poter truck at a section of about 5km from the front of the road in front of the Tong-si to the front of the “F” in front of the same Ri, while under the influence of alcohol level of 0.179% on September 18, 201.
(2) Defendant A, from the end of September 201 to the early November 1, 201 of the same year, had Defendant B, who was aware of at ordinary times, for the purpose of hiding the fact that he driven under the influence of alcohol as above, requested Defendant B to make a statement as if he driven the cargo at the investigative agency on September 18, 201, and requested Defendant B to make a statement at the investigative agency on November 11, 201 and January 26, 201, at the traffic survey division office of the common police station located in the Mine-gu Office where the luminous death drawings was located at the time of Yeongdeungpo-si, the investigator in charge, and Defendant B, from September 22, 2011 to the front road located in the same rith, Defendant B made a statement on September 28, 201 and Defendant B, at the police survey office of the common police station located in the Dong-si, the investigator in charge, Defendant B driven the G cargo on the front road located in the same rith.
3. On December 19, 19, the Ministry of Education, the Head Office of the Changwon District Prosecutors' Office, 304, located in the 67th west-ro, Dong-si, Dong-si, and made a statement to the same purport.
As a result, Defendant A instigated Defendant B to escape a person who committed a crime corresponding to a fine or heavier punishment.
B. Defendant B asked Defendant B to make a false statement at the investigative agency upon Defendant B’s request, as seen above, and stated that Defendant B driven G cab from the front of Sim-si E to the road “F” in front of the same Ri located on November 11, 201 and January 26, 2012 at the transportation survey department office of Sim-gu Police Station where the luminous death is located in Simyoung-si, and Defendant B driven G cab at around 22:00 on September 18, 201, and the same year from February 28, 2012 and the same year.
