A defendant shall be punished by imprisonment for not less than eight months.

The defendant shall pay one million won to the applicant for compensation by fraud.

Criminal facts

[2013 Highest 1840] On August 20, 2011, the Defendant stated that “The Defendant, at the home located in 105 dong904, Daegu Northern-gu D building, 105, 904, the victim E, who is a neighboring resident, would purchase the said company’s factory, and would purchase the money at a higher price than the market.”

However, the Defendant received money from the victim as a result of the lack of living expenses due to divorce with her husband and the lack of two children, and then purchased some electronic equipment from the city to purchase them, and it was thought that the Defendant continued to receive money from the victim under the same name and use them for short-term living expenses, etc., and did not have any intention or ability to purchase electronic equipment to the victim.

As above, the Defendant, by deceiving the victim, received a transfer of KRW 600,000 from the victim on August 20, 201, for the purchase of electronic equipment, and received a total of KRW 4730,000 from the victim until August 31, 2011.

In addition, the Defendant received a total of KRW 37,321,600 from around that time to February 6, 2013, as stated in the separate crime list, and acquired it by deceptioning KRW 37,321,60 over 48 times.

[2013 Highest 1879] On August 2011, 201, the Defendant received 1.59 million won from the victim F of the victim F, who was known to the general public, by stating that “I may purchase money in the LG Gu factory which makes the kim air conditioning and TV, at KRW 690,000,000, TV may purchase money at KRW 9,000,000,000.”

However, the defendant thought that he would use the money in order to pay damages to a similar fraudulent case in the past, so even if he received money from the victim, he did not have the intention or ability to purchase the money with the kimchi cooling and TV.

The Defendant is the victim as above.
