[ 모두사실] 피고인 A은 중국에 있는 보이스 피 싱 조직 총책인 H의 처남으로 H의 지시에 따라 보이스 피 싱 범행에 사용되는 통장을 만들어 인출 책에게 전달하거나, 타인 명의의 대포 통장, 현금카드 등을 인출 책에게 전달하는 전달 책 역할을 하고, 피고인 B과 피고인 C은 H로부터 ‘ 위 챗 (we chat)' 이라는 채팅 어 플 리 케이 션을 통해 지시를 받아 보이스 피 싱 사기 범행을 당한 불상의 피해자들 로부터 송금 받은 돈을 인출하여 이를 H가 지시하는 다른 계좌로 송금하는 인출 책 역할을 하기로 하여 보이스 피 싱 사기 및 공갈 범행을 공모하였다.

이에 따라 피고인 A은 자신 명의로 편취한 돈을 이체 받는데 사용할 계좌를 개설하고 2016. 2. 일자 불상 경 기업은행 계좌 (I), 2016. 3. 일자 불상 경 국민은행 계좌 (J), 농협 계좌 (K), 우리은행 계좌 (L), 2016. 5. 일자 불상 경 농협 계좌 (M) 의 계좌정보가 적혀 있는 부분을 촬영하여 ‘ 위 챗’ 메신저를 통해 H 측에 전달하고, 그 외에도 H의 지시에 따라 계좌번호 불상의 타인 명의 계좌 수개와 그에 연결된 현금카드 등 접근 매체, 노트북, 카드 복제기를 피고인 B, 피고인 C 등 인출 책에게 전달하였다.
