1. The Defendants jointly share KRW 34,325,80 with respect to the Plaintiff and the period from April 5, 2017 to September 18, 2017.
Reasons
1. Details of ruling;
(a) Business name: A summary of the project: A road project (construction work (local highway C) (hereinafter referred to as the “instant project”) - the project site: Drith to Erith Urban Area: The project implementer: the Defendants - the public notice of the determination of the road zone (change) on September 25, 2014, and the public notice G of Gyeonggi-do on August 25, 2016.
B. The Central Land Tribunal’s ruling on expropriation on February 9, 2017 - The date of expropriation: The date of expropriation: each land indicated in the column for “subject to expropriation” in attached Table 1 attached to the instant project zone owned by H (hereinafter “each land of this case” and each land shall be indicated only as “I land”: The individual land shall be indicated as “land”) - Compensation: It shall be calculated as indicated in the attached Table 1’s “amount of compensation for expropriation” column - An appraisal corporation, E-Appraisal Corporation, Inc., and the Japanese Appraisal Corporation.
C. The order of seizure of a claim as of March 2, 2017 and order of assignment of a claim as of March 16, 2017 - The seizure and assignment of a claim as of March 16, 2017: Until the amount reaches KRW 156,00,000, which is the maximum debt amount among the claims for compensation for the expropriation of each of the instant lands held by H against the Defendant Land and Housing Corporation, as a mortgagee for each of the instant lands under the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects (hereinafter “Land Compensation Act”):
(d) Results of the appraisal by the appraiser J (hereinafter “court appraiser”) - The court appraisal results: Attached Table 1 attached hereto - The fact that there is no dispute as stated in the court appraisal results [based on recognition], Gap evidence Nos. 1 through 7 (including each number; hereinafter the same shall apply), the court appraisal results by the court appraiser before the court, and the purport of the whole pleadings
2. As to each of the instant lands asserted by the Plaintiff, the difference between the legitimate amount of compensation according to the court’s appraisal and the amount of compensation for expropriation.
