1. Basic facts
A. On May 1, 2006, the Plaintiff was a foundation established on May 1, 2006 for the purpose of managing the property of “D”, which is a social welfare facility, and E, the Plaintiff’s representative, began to manage the said “D” from November 1, 1976.
B. The land of this case is unregistered land (hereinafter “instant land”). The land cadastre (No. 3; hereinafter “instant land cadastre”) and the former land cadastre (the evidence No. 2; hereinafter “instant land cadastre”) are indicated as being the land assessment of the instant land around May 10, 1912 by the person “B” around May 10, 1912.
The land cadastre of this case is written as “Fi” in the address column of the owner “B,” and the land cadastre of this case is written as “G” in the address column of “B.”
C. Around April 25, 1987, Nonparty H purchased the instant land from Defendant B, and around April 25, 1987, E purchased KRW 1,500,000 from H and occupied the instant land from around April 26, 1987, and occupied the instant land from around April 26, 1987, and thereafter incorporated the instant land into the facility site of “D” and used it as part of the “I Education Center,” adjacent to the road, J Park, and Outdoor Stage, including the instant land, around May 13, 1997. Nonparty L, an incorporated foundation (hereinafter “Nonindicted Foundation”) managing the “D” facilities, which are social welfare facilities affiliated with K, owned and managed the instant “D” site and buildings, which are annexed facilities.
The plaintiff, around December 2006, had the facility management of "I" followed the non-party foundation, has been transferred the land of this case, which is part of the above training institute site, used and managed as part of the road, park, and outdoor stage within the training institute, and has been occupied until the date of closing argument.
