The defendant shall pay 245,00,000 won to the plaintiff and 12% per annum from November 2, 2019 to the day of full payment.

Facts of recognition

On September 3, 2018, the Plaintiff concluded a sales contract (hereinafter “instant sales contract”) with the Defendant to purchase KRW 245,00,000 from the Defendant for the purchase price of KRW 245,00 (hereinafter “each of the instant real estate”) with the instant land and its ground buildings (hereinafter “instant building,” referring to land and buildings, and hereinafter “each of the instant real estate”).

According to the instant sales contract, the Plaintiff paid the Defendant a down payment of KRW 25,00,000 on the day of the contract, and KRW 220,000,000 on October 26, 2018, respectively, and completed the registration of ownership transfer on each of the instant real estate on October 26, 2018.

At the time of purchase of each of the instant real estate, the Plaintiff identified the current status of each of the instant real estate and the boundary indicated as stone axis, and entered into the instant sales contract.

그런데 위 석축으로 표시된 이 사건 토지의 현황상 경계는 별지 감정도 중 ㅁ, ㅂ, ㅅ, ㅇ, ㅈ, ㅊ, ㅋ, ㅌ, ㅍ의 각 점을 차례로 연결한 선인데, 지적도상 실제 이 사건 토지의 경계인 별지 감정도 1, 2, 3, 4, 5, 6, 7, 8, 1의 각 점을 차례로 연결한 선과 차이가 있다

(별지 감정도 ㅈ, ㅊ, ㅋ, ㅌ, ㅍ, 6, 5, 4, 3, ㅈ의 각 점을 차례로 연결한 선내 부분의 면적은 약 118㎡이다). 위와 같은 지적도상 경계와 현황상 경계의 불일치로 인하여 원고는 이 사건 토지와 연접한 D 토지의 소유자인 E종중으로부터 2019. 5. 8. 토지원상복구 및 토지 사용료 지급 청구를 받았다.

[Ground of recognition] The facts that there is no dispute, Gap No. 1-5 (including the serial number), and the plaintiff's assertion of the parties to the purport of the entire pleadings concluded the instant sales contract due to a mistake on the boundary of the land in this case, and such a mistake constitutes an error on the important part of a juristic act.

Therefore, the plaintiff revoked the sales contract of this case on the ground of the above mistake, and made the sales amount with unjust enrichment.
