1. Defendant A shall be punished by imprisonment for three years and by a fine of thirty-seven thousand won.
except that for five years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Defendant A was a public official of the Ministry of Justice’s immigration control, from August 2008 to January 27, 2012, Defendant A served as the chief of the J of the Gwangju Immigration Office, and from January 28, 2012, Defendant A served as the chief of the K of the Gwangju Immigration Office.
On January 24, 201, the Defendant was transferred KRW 37,000,000 from the above date to April 30, 2012 to the account under the name of the Defendant in attached Form 20 times in total from the above date and time to April 30, 201, under the pretext of the following: (a) from the Gwangju Immigration Office located in Seo-gu, Seo-gu, Gwangju, Gwangju, for the sake of immigration-related affairs, such as application for registration of foreigners, extension of status of stay, and application for change of status; and (b) from the M that the Defendant provided the above M with convenience, such as providing the above foreigner with personal information on entry into and departure from the Republic of Korea; and (c) the Defendant was transferred KRW 1,50,000 from the above date and time to the account under the name of the Defendant.
Accordingly, the defendant accepted a bribe in relation to his duties.
(b) No current or former employee of a public agency who manages personal information in violation of the Personal Information Protection Act shall divulge or process such information obtained in the course of performing his/her duties, provide it to others for unlawful purposes;
Nevertheless, at around 10:58 on September 26, 201, the Defendant requested the above Gwangju Immigration Office to inquire about personal information about the husband of the aboveO by way of receiving text messages from the Internet facsimile (www.afax.com) via the Defendant’s cell phone from the above M, and immediately searched computerized data managed by the Immigration Office to inquire about the above husband’s personal information, and then inquire about the above husband’s personal information by telephone.
