A defendant shall be punished by imprisonment for not less than one year and six months.

915,000 won shall be additionally collected from the defendant.

The additional collection charge shall be equivalent to the above additional collection charge.

Punishment of the crime

1. Despite the fact that the Defendant is not a person handling narcotics, etc., the Defendant treated narcotics as follows. A.

On January 23, 2019, the Defendant received KRW 150,000 in cash from F in the vicinity of the Michuhol-gu Incheon apartment, Michuhol-gu, Incheon, and sold a disposable injection device containing approximately KRW 0.35 g of psychotropic drugs (one philopon; hereinafter “philopon”).

B. At around 00:00 on February 11, 2019, the Defendant purchased philophones with cash of KRW 200,000 and approximately 0.7 g of philophones in the vicinity of H convenience stores in Michuhol-gu Incheon Metropolitan City.

C. On February 12, 2019, the Defendant: (a) around 17:35, around the 17:35th day of the Incheon Michuhol-gu, sent a paper bag containing a disposable gate containing approximately 0.13g of oponononon to Ma who was a partner of the vehicle in order to sell oponon to L; and (b) caused M to put it on a nearby dump truck back heading part of the pump truck parked in the vicinity; but (c) reported to the police that the above dump truck article, which caused M to win on his behavior, brought it to the police.

Accordingly, the Defendant attempted to sell philophones to L, but did not bring about such intent and did not commit attempted crimes.

On February 2, 2019, the Defendant issued Q from the O building P, one-time injection equipment containing approximately 0.28g of opon, which is one’s residence in Michuhol-gu Incheon, Michuhol-gu, Incheon, to Q free of charge.

E. At around 18:00 on March 2, 2019, the Defendant transferred KRW 300,000 from F to M account in the name of M, and on March 3, 2019, around 09:30 on the following day, the Defendant sold phiphones by way of sending the phiphones to the baggage of the Gangwon-gu Senior Bus with approximately 0.7g of phiphones in the Incheon Michuhol-gu, Incheon at around 09:30 on March 3, 2019.
