Reasons
Punishment of the crime
1. Defendant A
A. The Defendant is the representative of B Co., Ltd. located in E in Ischeon-si, and B Co., Ltd. was designated by the Administrator of the Gyeonggi-do Food and Drug Safety Management and Certification Criteria for Food Safety Management (hereinafter “HCCP”) with respect to Choun Kim.
No business operator of a business subject to the HACCP shall entrust the manufacturing of certified food to another business operator.
Nevertheless, around August 30, 2014, the Defendant entrusted the manufacturing of 29,90 Choun Kim (hereinafter “F”) that was designated as the HACCP by the Defendant company (hereinafter “Defendant”), to G that was not certified as the above HCCP, and entrusted the manufacturing of 29,90 items (hereinafter “F”) to G that was not certified as the above HCCP and caused the manufacturing to be offered. From the above date to June 25, 2015, the Defendant entrusted the manufacturing of 3,167,371 items (total 231,134,828 won) in the same manner as the attached Table 1 in the list of crimes.
(b) No one shall indicate or advertise foods, etc. differently from facts or exaggeratedly with respect to the indication of names, manufacturing methods, quality nutrition labelling, genetic materials, associations of food, etc. and food history tracking and management;
Nevertheless, around March 5, 2012, the Defendant advertised 1,437,242 products with the same method as attached Table 2, among around the above day to July 15, 2015, as if the Defendant had been certified as HCCP in the product package of “H” and “I,” and as if he had been certified as HCCP, the Defendant advertised 1,432,00 products with the same method as in attached Table 1,437,242 products, including the total of H 1,437, and the total of 5,242 products.
2. Defendant B, at the time and place specified in paragraph (1), the Defendant, a representative director of the Defendant, committed the above violation in relation to the Defendant’s business.
