1. The Defendant: (a) KRW 5,518,700 for the Plaintiff and KRW 6% per annum from June 26, 2013 to May 28, 2015.

1. Basic facts

A. The Plaintiff is a company engaged in the business of manufacturing and constructing solar-powered facilities, and the Defendant was a company engaged in the business of overall supervision, electric design supervision, etc., and the Defendant was selected as a “Asolar-Building Business” entity conducted by the Energy Management Corporation to expand the distribution of solar-powered power infrastructure.

B. The Defendant concluded a solar-powered installation contract with 45 customers recruited by B through the Plaintiff’s introduction, and concluded a material supply contract with the Plaintiff to supply the materials necessary for the said construction (hereinafter “instant material supply contract”).

C. The Plaintiff supplied materials to the Defendant in accordance with the instant material supply contract. The Defendant, at the price of the materials, supplied the Plaintiff with the amount of KRW 45 million on April 19, 2012, KRW 64 million on May 18, 2012, KRW 20 million on June 22, 2012, KRW 46 million on July 24, 2012, KRW 10 million on July 20, 2012, KRW 600 on August 16, 2012, KRW 50 million on August 22, 2012, KRW 380,5780 on November 7, 2012, and the Plaintiff issued the said tax invoice.

On April 1, 2013, the Defendant requested the Plaintiff to issue a performance guarantee insurance policy with respect to the materials supplied as above. Accordingly, the Plaintiff and the Defendant drafted a material supply contract in which the contract amount is KRW 393,058,800, retroactively from October 1, 2012, and based on this, the Plaintiff issued a performance guarantee insurance policy from the Seoul Guarantee Insurance Co., Ltd. to the Defendant from October 1, 2012 to September 30, 2015, and based on this, the Plaintiff issued a performance guarantee insurance policy with the subscription amount of KRW 393,058,80,000, and the insurance period of KRW 393,058,80,000 from October 1, 2012 to September 3

E. The Defendant entered into a solar-powered installation contract with seven customers additionally recruited, provided the Plaintiff with materials necessary for the above construction, and received materials from the Plaintiff even in solar-powered installation works implemented by the Defendant in the D market, C, etc. directly operated by the Defendant.
