라. 이 사건 심결의 경위(갑1호증) 1) 원고는 2015. 8. 10. 특허심판원에 이 사건 등록서비스표 ‘’의 서비스표권자인 피고를 상대로,「이 사건 등록서비스표는 선등록상표 1 ‘’ 및 선등록상표 2 ‘’ 원고는 당초 이 사건 심판단계에서는 이 사건 등록서비스표에 등록무효사유가 존재한다면서 그 근거로 J 출원되고 K 등록된 상표등록번호 L의 선등록상표 2를 제출한 바 있으나, 이 사건 소송에서는 이를 증거로 제출하지 않은 채 그에 관한 주장도 하지 않고 있다.
