The judgment of the court below is reversed.

The defendant is not guilty, and the summary of the judgment of innocence is publicly notified.

Reasons

1. The summary of the facts charged in the instant case is that the Defendant, as a person subject to enlistment in active duty service, failed to enlist in the military unit in the name of the director of the regional military manpower office in the Chungcheong-gun, Chungcheongnam-si from November 9, 2015 to December 14:00 of 29, 2015, to be enlisted in the 37 team located in Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si, and to be enlisted in the military unit without justifiable grounds for three days from the date of enlistment.

2. The lower court found the Defendant guilty of the instant charges on the ground that even if the Defendant refused enlistment based on a religious belief, that alone does not constitute “justifiable cause” under Article 88(1) of the Military Service Act.
