1. All of the plaintiff's claims are dismissed.

1. Basic facts

A. The Plaintiff is a terrestrial broadcasting company that operates broadcasting business and cultural service business with nationwide broadcasting zones and viewing rights, and the Defendant is an online newspaper “B” (C) publisher.

B. On January 6, 2015, the Plaintiff reported news news of the title “MBC” news program, “Special Act on Compensation for Damage Caused by the 4/16 Sewol Ferry Disaster,” “The National Assembly in the Program,” “Special Act on Compensation for Damage Caused by the Second Year 16 Sewol Ferry Disaster,” [Final Agreement].

The news report of this case hereinafter referred to as "the news report of this case"

(C) As to this, the Defendant posted the instant article as shown in Appendix 1 in the column of B’s website under the small title and [G] of the largest title of E [F] (On the other hand, according to the conciliation by the Press Arbitration Commission, a counterargument report was published at the bottom of the instant article, as shown in Appendix 1, as shown in Appendix 1.

2. Determination on the cause of the claim

가. 원고의 주장 피고는 이 사건 기사에서, ① 원고가 뉴스데스크 프로그램을 통해 세월호 사건 진상조사위원회에의 수사권ㆍ기소권 부여에 관한 논란 과정 및 이에 대한 유가족과 여야 정치권의 입장, 세월호 특별법 협상의 구체적 내용, 시민단체의 의견 등을 다양하고 상세하게 보도하였음에도 불구하고, ‘유가족들과 시민사회의 주장은 <뉴스데스크>를 통해서는 거의 전해지지 않았다’고 허위사실을 적시하고, ② 원고가 이 사건 뉴스데스크 보도에서 대입특례 조치나 국민성금 활용 등을 기화로 세월호 사건 유가족들을 매도한 바 없음에도, ‘우리 가족들이 요구해서 대입특례가 되는 것처럼, 국민성금을 모두 우리 가족들에게 나눠주는 것처럼 정말 교묘하게 가족들을 매도하는 MBC!!'라고 보도함으로써 독자들로 하여금 마치 원고가...
