1. On the Plaintiff (Counterclaim Defendant),
A. The Defendant (Counterclaim Plaintiff) is jointly and severally with the Bad Industry Development Co., Ltd. and KRW 100 million.
Reasons
Ⅰ. The part of the principal claim
1. On or around November 11, 2004 and July 21, 2005, Defendant B borrowed an aggregate of KRW 55 million for business funds and design expenses of the Defendant Company and the Bad Industry Development Co., Ltd. (the Plaintiff also filed a lawsuit by taking the Defendant as to the decision of recommending reconciliation as of January 27, 2016 of this Court, but the Plaintiff and the Bad Industry Development Co., Ltd. did not raise an objection to the decision of February 20, 2016, which became final and conclusive on February 20, 2016). From July 22, 2005, the Defendants and Bad Industry Development Co., Ltd. (the Defendants did not agree to pay KRW 10,000 to the Plaintiff by July 30, 2005, and each of the Defendants’ respective agreements to the effect that the Plaintiff would incur damages to the Plaintiff by adding up KRW 100,000,000 to the Plaintiff’s oral pleading and 29.29.
In accordance with the above facts of recognition, the Plaintiff, and ① the Defendants jointly and severally with the Bad Industry Development Co., Ltd., and (i) from August 1, 2005 to December 11, 2015, a copy of the complaint of this case from August 1, 2005, to December 11, 2015, which is the date following the due date under the first agreement with the Defendants, are served on the Defendants, 5% per annum as stipulated in the Civil Act, and interest for delay calculated at the rate of 15% per annum as stipulated in the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, etc., from the following day to the date of full payment. ② The Defendants jointly and severally agreed to limit the principal amount of KRW 100 million per annum from January 1, 2010 to the date following the due date under the second agreement, to the date on which the copy of the complaint of this case was served on the Defendants, 5% per annum as stipulated in the Civil Act, and 15% interest per annum.
