A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Around May 8, 2017, the Defendant requested D to dispose of land located in Gyeongbuk-gun E (hereinafter “instant land”) owned by the Defendant, and agreed to pay 80 million won out of the land price to D as the fee, the remainder to D. On or around July 8, 2017, the Defendant: (a) prepared a letter of proxy of delegation of land purchase and sale and a letter of consulting with D to the same effect; (b) accordingly, the Defendant received money from D for the remaining 36,676,270 won after deducting loans, etc. from D around July 12, 2017; and (c) the Defendant received money from D for the purpose of returning 146,67,270 million won from D’s land price to the public prosecutor’s office with a large amount of interest of 160 million won from July 2017.
On September 6, 2017, the Defendant submitted a false complaint to the public prosecutor’s office of the Incheon local public prosecutor’s office located in 49, Nam-gu, Incheon, Incheon, the Nam-gu, Incheon, the 49-ro 163, and to the effect that “D, an individual among real estate, signed in the blank from the Defendant requesting the disposal of the instant land on June 8, 2017,” “The Defendant forged the power of representation for the purchase and sale of land in the name of the Defendant, forged the power of representation for the purchase and sale of the land, and obtained it by not paying part of the purchase and sale amount,” and made a false statement to the police officer in charge of the investigation of the Incheon Southern Southern District Police Station located in 290, 32, Nam-gu, Incheon, and the K Team office.
As a result, the defendant brought an accusation against the victim for the purpose of criminal punishment.
