가. 2014. 10. 초순 21:00경 업무방해 피고인은 2014. 10. 초순 21:00경 울산 남구 D아파트 상가 1층 피해자 C(41세)가 운영하는 ‘E마트’에서 술에 취하여 피해자에게 “이 씨발 것들아, 가게 앞에 진열된 물건 빼라, 왜 인도에 물건을 쌓아놓고 있노, 씨발것들, 구청에 신고한다, 이 씹새끼야, 내가 담배 사려고 할 때 없다고 했지, 담배를 사재기 해놓고 오르면 팔려고 하지, 내가 한번 찾아보자”라고 큰소리를 치면서 위 마트 계산대에 있는 종업원을 밀치고 계산대 안으로 들어가 담배가 있는지를 확인하고, 이를 쳐다보고 있던 손님들을 향하여 “뭘 쳐다보냐, 이 씨발년들아”라고 큰소리로 욕설을 하여 불안감을 느낀 손님들이 위 마트에서 나가도록 하여 위력으로 약 20분 동안 피해자의 위 마트 운영업무를 방해하였다.
