Punishment of the crime

1. On November 6, 2015, the Defendant violated the Act on the Punishment, etc. of Sexual Crimes (infringed places for sexual purpose), committed in front of the Defendant’s 3rd female public toilets located in Spocheon-si B around 17:22 on November 6, 2015, and entered the front of the Defendant’s mobile phone camera in order for women to take a melted image into the front of the Defendant’s mobile phone camera.

Accordingly, the defendant invadeds on female public toilets, which are public places, with a view to meeting his sexual desire.

2. 성폭력범죄의 처벌 등에 관한 법률위반( 카메라 등 이용촬영) 미 수 피고인은 2015. 11. 6. 17:28 경 위 화장실 두 번째 용 변 칸에서, 피고인의 아이 폰 6 휴대 폰 카메라를 켠 다음 피해자 D( 여, 16세) 가 용변을 보고 있던 첫 번째 용 변 칸의 칸막이 밑으로 위 휴대폰을 집어넣고 피해자의 신체를 훔쳐보며 피해자의 용변 보는 모습을 촬영하려고 하였으나, 다른 사람이 화장실에 들어오는 소리를 듣고 발각될 것이 두려워 촬영하지 못하여 그 뜻을 이루지 못하였다.
