Defendant shall be punished by a fine of KRW 2,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

From October 5, 2010, the Defendant operated the number system of 30 units of the Gu, 10 million won per unit, 350,000 won per unit, 350,000 won per unit, and 5 days “5 days” on March 5, 2013. From May 10, 2011, the Defendant operated the number system of 30 units of the Gu, 10,000 won per unit, 350,000 won per unit, 350,000 won per unit, 10,000 won per unit, and 10,000 won as of October 10, 2013.

On February 28, 2012, the Defendant: (a) on February 28, 2012, the date of commencement; (b) July 30, 2014; (c) on July 30, 2014; (d) on an old unit; (d) on an old unit, KRW 10 million per unit; and (e) on an opportunity to operate the 350,000 won number system of the old unit; and (e) solicited the victims to enter the accounts.

On February 2, 2012, the Defendant had a mind to pay the guidance money by lending money from the victim C, in a situation where some of the members of the above five-day number system and the 10-day number system did not pay the guidance money, and it is impossible to supplement the amount of guidance money not paid with the property owned by the Defendant, and it is impossible to pay the guidance money to the relevant fraternity.

However, in fact, around February 2012, the members, who subscribed to the number system of Defendant’s operation, began to delay the payment of some deposits. Since the property owned by the Defendant was almost little without any property owned by the Defendant, there was no intention or ability to repay the said property as agreed upon by the victim.

Nevertheless, on February 17, 2012, the Defendant, at the same time, makes a false statement, stating that “10 million won shall be repaid to the victim C within several months if he/she loans to the victim C. It shall be repaid at any time if he/she talks with him/her in advance only 30 days prior to a month. If he/she has subscribed to one unit in the 30-day number system to be operated, he/she shall be 350,000 won per month, and 2% interest per month on 10,000 won shall be recognized as a deposit amount, and it shall be acquired by transfer from the victim C to the Defendant’s ancillary account under the pretext of borrowing money, and 20 million won shall be transferred from the victim to the Defendant’s ancillary account around May 9, 2012.”
