Reasons
Punishment of the crime
[2016 Highest 5325] The Defendant was an employee working in the “C”, who is acting as a broker for real estate mortgage loans, and the Defendant was urgently required to pay funds by failure to make a stock investment. On April 2014, the Defendant was willing to forge a detailed statement of transfer generation inspection of apartment units offered as security by D and to obtain money exceeding the amount requested for the loan by personal use of the amount in excess of the amount requested for the loan.
1. Around May 2014, the Defendant forged public document: (a) based on the 2014.10 C office of office in Gangnam-gu Seoul Metropolitan Government, “2 May 22, 2014” and “F, G, and D” and “F, G, and D” in the column of the date of publication, the Defendant created a pattern similar to the original form by using the Korean language program stored therein, such as the size of characters, letters, and strings, which are similar to the original form, and then printed out in the new form of “D”.
Accordingly, for the purpose of exercising, the Defendant forged a statement of inspection of transferred households, which is an official document under the name of the head of the Dong in Nam-gu Incheon Metropolitan City.
2. On June 2014, the Defendant: (a) borrowed KRW 70 million from KR as set forth in the following, in front of the Youngdong-gu, Yongsan-gu, Seoul Special Metropolitan City; and (b) submitted to K as if he were issued a genuine statement of forged transfer household inspection as stated above, which was necessary for the loan; and (c) exercised it.
3. Fraud;
A. A. Around May 29, 2014, the Defendant made a false statement to the above C Office where the Defendant works for the Defendant, namely, that “A person D was transferred to a mixed householder of H apartment No. 115 Dong-gu, Incheon Metropolitan City H apartment No. 115 and No. 403. Around May 29, 201, the victim K transferred the above apartment owned by D to the victim K.”
