Punishment of the crime

[2013 Highest 1218] On September 27, 2012, the Defendant: (a) around September 22, 2012, E “E” operated by the victim D in Gwangju Northern-gu, Gwangju, that the Defendant would normally pay the drinking value despite the absence of the intent or ability to pay the drinking value; and (b) ordered alcoholic beverage and demanded the provision of the service; and (c) was provided by the victim with the total amount of KRW 70,000,000, including the five types of singing rooms and singing bags.

Accordingly, the defendant, by deceiving the victim, obtained property benefits equivalent to KRW 70,000.

[2012 Highly 2541] On October 02, 2012, the Defendant received alcoholic beverages of an amount equivalent to 140,000 won, and took property benefits, without any intention or ability to pay the drinking value, from the “H point operated by the Victim G (VV) located in Seo-gu, Seo-gu, Gwangju-gu, Gwangju, by means of alcoholic beverages of an amount of 10,000 won, such as 10,000 won, per day, per day, per day, and per day.

[2013 Highest 1606] On November 26, 2012, the Defendant, around 23:30 on the second floor of the Seo-gu, Seo-gu, Gwangju, by providing the victim N with alcohol, alcohol, etc. at “O entertainment drinking house” operated by the second floor of the Seo-gu, Seo-gu, Gwangju. As if he would pay for the drinking, alcohol, etc., he/she ordered drinking, etc.

However, even if the defendant was provided, he did not have the intention or ability to pay the price.

In this respect, the Defendant was provided with the victim with a total of KRW 160,000,00.
