Of the facts charged in this case, the details of the attached money and valuables in arrears Nos. 1, 3, 5, 7, 8, 9, 10, 11.
Reasons
Punishment of the crime
Defendant 2, as the representative director of the D Co., Ltd. in Jinju City, is an employer who runs the manufacturing business of special purpose machinery using 60 full-time workers.
1. The Defendant violated the Labor Standards Act, without agreement, did not pay KRW 50,771,132, including the overdue wages, etc. in total under 17 re-employed 17 persons at the above workplace, within 14 days from the date of occurrence of the reasons for payment, without agreement, regarding the extension of the payment deadline between the parties.
2. The Defendant violated the Workers’ Retirement Benefit Security Act, at the above workplace, did not pay KRW 34,597,120 in total, 34,597,120 in total, 10 re-employed workers in arrears in attached Form 2, 14, 15, 19, 22, 32, 34, 39, 39, 48, and 49, respectively, within 14 days from the date on which the cause for payment occurred, without any agreement.
Defendant 1 operated D Co., Ltd. located in Jinju City 738, May 29, 2012, from May 29 to May 16, 2014, 2014, Defendant 2 provided the victims with total of KRW 1.78 billion from the Small and Medium Business Corporation’s factory site, building, and machinery and equipment installed in the above factories as security, and the Defendant had a duty to keep KRW 9 of the above D Co., Ltd. for the purpose of security until the victims fully repay their liabilities for the above loans.
1. Nevertheless, on November 28, 2015, the Defendant violated the foregoing duties, and around 28, 2015, 30 million won to E, the machinery and tools with a total of 4 points, including a total of 1,45,00,000 won from the 9 points of the said machinery and instruments (an appraised appraised value of KRW 145,00,000), a vertical machine learning center (an appraised value of KRW 260,00,000), and a total of 30,000,000 won from the Korean precise CNC vertical line (appraisal appraised value of KRW 70,00,00).
