【Criminal Facts】

1. The Defendant and C purchased real estate similar to the lease deposit and the purchase price in the name of the Defendant, and subsequently conspired to acquire money by means of preparing a false lease contract as if the lease deposit was paid with a significantly lower amount than the actual lease deposit in order to look at as if the real estate had a value as collateral.

The Defendant and C around April 1, 2015: (a) at the office of the victim E in Bupyeong-si, Busan; and (b) at the victim’s office, the Defendant and C created a collateral security with the payment of interest on KRW 50,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,

In fact, however, the above real estate provided as security to the victim had no collateral value due to the lessee who has the opposing power over the deposit amount of KRW 125 million, and the defendant and C did not have the intent or ability to repay the borrowed money as agreed without any specific property.

Nevertheless, the Defendant, in collusion with C, received a total of KRW 4,8250,000,000 from the victim, including KRW 21 million, and KRW 27250,000,00,000,000,000,000,000 from the H Association account (I) in the name of C on the same day.

A. The Defendant and C, who committed the crime against the victim E, purchased real estate similar to the lease deposit and the purchase price, in the name of the Defendant, the real estate value as security.
