The defendant does not make a move-in report to prevent the delivery of a call-up notice for training of the reserve forces to the reserve forces without justifiable grounds while moving his/her place of residence from the Ulsan-gu Seoul Metropolitan Government to the Buddhist area of the racing-si on January 2012.

The defendant alleged to the effect that the "place of residence" requiring a report under the Resident Registration Act is not punishable as a violation of the Establishment of homeland Reserve Forces Act because his parents are merely a registration of unknown domicile on the part of the defendant's domicile, because the defendant's parents did not report his domicile to the defendant. However, according to Article 15 (2) of the Establishment of homeland Reserve Forces Act, the defendant shall punish the person whose domicile is registered because he did not report pursuant to Article 10 of the Resident Registration Act without any justifiable reason so that he could not deliver a notice of convening the training of the reserve forces, and pursuant to Articles 10 and 6 (1) of the Resident Registration Act, his residence refers to "the domicile or residence for 30 days or longer", and the resident should report his domicile or place of residence before moving his residence to the head of Si/Gun/Gu having jurisdiction over the place of residence and the date of his domicile at the time of his residence from the point of time before moving to the point of 200 on May 21, 201.
