1. The Plaintiff:
A. Defendant B shall have full payment of KRW 64,274,11 and KRW 50,00,000 among them from April 11, 2019.
Reasons
1. Facts of recognition;
A. Defendant B borrowed money from the Plaintiff as follows:
(1) “The interest rate of KRW 14.4% per annum (14.4% per annum from May 11, 2011 (12% per annum from March 5, 2016) 18% per annum 14.4% per annum from May 11, 2011 (12% per annum from March 5, 2016) 10,000,000 per annum 15% per annum from May 30, 2013 (10% per annum from May 3, 2013) 10,000,000 per annum 18% per annum from September 29, 2016 (20.3.26. 20. 20, 2016. 1. 205. 205. 205. 205. 205. 205. 205. 205. 25. 2016. 2015. 2015. 205. 20. 2015.
Defendant C and D are children of Defendant B.
Defendant D paid the Plaintiff KRW 2,50,000,00 on February 26, 2016, and KRW 2,500,000 on March 29, 2016, and KRW 5,00,00 on October 1, 2016, to the Plaintiff for the repayment of Defendant B’s debt.
The Defendant appropriated the total amount of KRW 5,00,000 as of February 26, 2016 and March 29, 2016 to repay the principal of the obligation under the foregoing paragraph (4), and the amount as of October 1, 2016 was appropriated for performing the principal of the obligation under the foregoing paragraph (2).
C. On December 30, 2016, Defendant C and D drafted a loan certificate stating to the Plaintiff as of May 3, 2013, interest rate of 1.25%, interest rate of 1.5%, interest rate of 1.5%, and the due date of repayment of March 29, 2017 as to the remaining debt of 5,00,000 won and the debt of 10,000,000 won under the above 3.
After that, Defendant D appropriated the Plaintiff’s total amount of KRW 3,00,000, KRW 2,000 on March 28, 2017, KRW 200,000 on October 23, 2017, KRW 1,500,000 on October 22, 2017, KRW 700,000 on October 24, 2017, KRW 29,500 on December 29, 2017, KRW 300,00 on January 25, 2018, KRW 1,300,000 on the principal amount, KRW 00,00 on January 31, 208, KRW 1,500 on the remainder of KRW 1,50,000 on the principal amount, KRW 300,00 on the debt repayment under the above provision, and KRW 1,500 on the remainder of KRW 1,303,2018.2
